The terms, policies and conditions (collectively known as "Conditions") described below govern the use of this site (referred to as "Back40Watches.com" or "site"). Your use and/or placement of any order indicates your acceptance of these Conditions with Back40Watches.com of Tx.

We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. We use this information to process your order(s) and only your order(s) and will not sell any of your personal information or contact you unless we have a question on your current order. We keep this information only to keep you updated on your order(s) and to personalize your shopping experience.
Our secure servers protect your information using advanced encryption techniques and firewall technology.
We will keep you informed about our latest offers if you subscribed to our Newsletter, this Newsletter will notify you of current promotions, specials and new additions to the Back40Watches.com site. You may unsubscribe from our newsletters by following the unsubscribe instructions in any email you receive from us at any time.

Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Back40Watches.com reserves the right at any time after receipt of your order to accept or decline your order for any reason.
Credit Cards
We accept the following credit cards: Visa, MasterCard, American Express and Discover. There is no surcharge for using your credit card to make purchases with Back40Watches.com. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order and may incur additional shipping cost if you enter a wrong shipping address. Your credit card will be billed when you finish placing your order.
Money Orders, Cashier’s Checks, Company Checks, & Personal Checks
Back40Watches.com accepts money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 5 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.
Cancelling an Order Policy
To cancel an order you must Call us and E-mail us at back40watches@sbcglobal.net within 24 hours of placing the order. If for some reason you get our Voice mail system, you must leave us a message telling us that you want to cancel the order, telling us you called is not going to do it, you must leave a message. If you do not cancel the order within 24 hours of placing it we can not guaranty that we can cancel the order and if we can cancel the order you will be responsible for all credit card charges that we are charged. All items have a shipping time but some may ship before this time. If it has shipped you can refuse delivery , but you will be responsible for the return shipping costs. If you refuse an item without getting an RMA # you will be charged a 20% restocking fee, all returns must have an RMA # and shipped to the address below. Any other returns that are returned to us within the 14 day period will be credited less actual shipping charges & 20% restocking fee for the item(s).
Shipping Policy
Shipping Time -- Most orders will ship within 5 business days of there posted time frame. Orders are not processed or shipped on Saturday, Sunday or Holidays.
We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by Back40Watches.com or other parties only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability. When placing your order please enter all fields in the checkout form in order and double-check this info. We will ship the item to the ship to address entered in the form at checkout. If you need this item by a certain date please tell us that in the Special Information box at checkout and we will try our best, and if we can not we will let you know in advance. We import all of the order info in to our system so you must enter all information in order so we ship the item to the correct address. Do not use the Special information box to correct the ship to address or anything like that, it is only for directions or need by date info. We will ship the items to the address that was entered at checkout and if this is the wrong address then you will be responsible for having it re-shipped to the correct address. If we do not know you need it sooner then normal then you may not get the item in time for the special occasion. Christmas orders are guaranteed to arrive by Xmas if placed by their Christmas Cutoff dates listed on each item. If they order does not make it by Christmas and you ordered early, you can either accept the package late, or refuse the package and a full refund will be issued. We cannot control what goes on at the Freight company, weather, act of God and therefore will do what is in our power to make it right.
Shipping Costs
Most items have the shipping cost included in the listed price, the only items that do not include the shipping are items that have to ship via a freight service other then UPS or Fedex. The Free Shipping means the shipping is free for the item shipped to you. But if you return the item then you will be responsible for the actual shipping charges to get the item to you and you will need to pay to have it shipped back plus any restocking fees. If you cancel the order after the item(s) ship or want to return the item, you will have to pay all shipping cost, when we receive the item(s) back to the address below and if they are not a non-returnable item(s), we will credit you card the total minus the shipping costs we paid to ship the item(s) out. You MUST get an RMA # for all returns. (Please see returns below for address).If you refuse an item without getting an RMA # you will be charged a 25% restocking fee, plus all shipping fee's, all returns must have an RMA # and shipped to the address below. Any other returns that are returned to us within the 14 day period will be credited less actual shipping charges & 20% restocking fee for the item(s).
Out-of-Stock Products
We will ship your product as it becomes available. Most orders will ship within 2 business days of there posted time frame. Orders are not processed or shipped on Saturday or Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.
Multiple Product Orders
For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.
Taxes
Back40Watches.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the state of Texas. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.
Returns
All Back40warches have a 1 year warranty on the whole watch. Warranty is Void if abused or mistreated. Orders that are cancelled after they ship or orders that are sent back for return/credit will have to pay all shipping Fee's ( no Exceptions, see Shipping Costs policy above). If you want to return your order you must obtain a RMA # to ship it back. All Returns without a RMA# will be sent back to the Customer as REFUSED and Customer will be responsible for their shipping charges. Please call us to Obtain an RMA#, you must ship the item back to the address below or it will be refused. If you refuse an item without getting an RMA # you will be charged a 25% restocking fee, all returns must have an RMA # and shipped to the address below. Any other returns that are returned to us within the 14 day period will be credited less actual shipping charges & 20% restocking fee for the item(s).
The warranty above is for manufacturing defects, any items found to have manufacturing defects will be replaced without question free of charge. We will credit your charge account for the cost of the item, and we do not reimburse the cost of returning the item. If you choose to make a return be Certain you understand this policy.
Typographical Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Back40Watches.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Back40Watches.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Back40Watches.com shall immediately issue a credit to your credit card account in the amount of the incorrect price
